Crossing the Street
If you are a pedestrian crossing a street, you must use a crosswalk, if available. If the crosswalk is controlled by a walk signal, you must obey it. If you cross the street outside of a crosswalk or against a signal, you do not have the right of way, and must yield to oncoming vehicles. Despite this duty, a driver has a duty to avoid hitting pedestrians in the roadway if possible. If a driver breaches their duty to avoid hitting a pedestrian crossing against a signal or outside of a crosswalk, and the pedestrian is injured, the driver can be sued for negligence.
